Before You Sign the Lease: The Smoke Shop Red-Flag Checklist (Free Version)
Ask experienced operators for the classic beginner mistake and you get the same sentence a generalist how-to printed in October 2026: "Signing a lease before checking zoning and licence availability." A lease is the one opening cost you cannot unwind. Clear these flags first.
The red flags
- A distance rule you have not measured. Schools, parks, churches, childcare — and other smoke shops — at property-line distance. Akron: one mile. Utah: 1,000 ft / 600 ft. Your city has a number; find it before the landlord finds you.
- A cap, freeze or moratorium. Los Angeles froze new smoke & vape shops in Council District 15 on July 10, 2026. New York City caps dealer licenses per district — some districts have none available. Pending proposals (Austin, New Orleans, Philadelphia, all fall 2026) can become your renewal problem.
- A license that takes a season. Chicago: 35–90 days after the fee. If your lease starts the clock before the license does, you are paying rent on a store that cannot legally open.
- A product plan your state bans. Directories (16 states), flavor bans (6 states + DC), origin bans (TX, IN), hemp bans (OH, TX, TN, AR). Inventory ordered against a dead plan is dead money.
- A lease with no contingency. If the license or zoning answer comes back no, can you exit? The kit includes a worksheet for the license-approval contingency conversation — landlords hear it more often than you think.
- A landlord who will not wait for the zoning letter. Pressure to sign before the city answers in writing is itself a red flag. The answer takes days; the lease takes years.
