Smoke Shop Zoning in Philadelphia, PA: Distance Rules & Permits

Verified local rules below

Office that decides: City of Philadelphia Dept. of Licenses and Inspections

RuleWhat it means for your address
PROPOSED (Oct 2026 — not yet law): 750 ft rulesA bill introduced in October 2026 would keep new nicotine shops 750 ft from schools, playgrounds and childcare — and 750 ft from other nicotine shops — with a 90%-transparent-window rule. It is a proposal, not a law, as of our October 2026 check. If you are signing a Philadelphia lease, ask the zoning office about it by bill name: proposals like this are exactly what 'verify before you sign' means.
Philadelphia City Council bill (introduced Oct 2026 — pending)
Pennsylvania's ENDS Directory already binds the shelvesWhatever the council does, the state directory (enforcement from Oct 19, 2026) already decides which vape products a Philadelphia shop may stock: 159 products, 6 manufacturers.
Pennsylvania Act 57 of 2025

The final word is still the city's. These rules are the verified ordinance layer as of October 23, 2026. A specific parcel can also turn on its zoning district, a conditional-use hearing, or a rule passed last month. Get the zoning office's answer for your exact address in writing before you sign.

The six-step city verification worksheet

  1. Get the parcel's zoning district from the city zoning map or the zoning office — in writing. 'Retail is allowed there' is not the same as 'a smoke shop is allowed there': many cities treat smoke shops as a special or conditional use.
  2. Ask the zoning office one exact question: 'What distance does this city require between a smoke shop and a school, park, church, childcare center, or another smoke shop?' Write down the number and the code section.
  3. Measure property line to property line — not door to door, not parking lot to parking lot. Cities measure from the parcel boundary, and a shop hidden across a park still counts.
  4. List every sensitive use inside that distance: schools (including preschools), parks, churches, libraries, childcare, youth centers — and every existing smoke or vape shop, including the one inside the gas station.
  5. Ask whether a conditional use permit or public hearing is required, how long it takes, and whether any cap or moratorium on new smoke shops is in force or pending at council.
  6. Do not sign the lease until the zoning office answers in writing. If you must sign, sign only with a license-approval contingency (the kit includes the worksheet for asking for one).
