Guide · checked October 23, 2026
Virginia changed the rules for smoke shops twice in ten months, and most guides have caught up with neither. First came the product layer: the Attorney General's liquid nicotine directory, with compliance required from December 31, 2025 and civil fines for off-directory products starting at $5,000. Then came the shop layer: from October 1, 2026, a retail tobacco permit is mandatory statewide — and selling tobacco without one is a misdemeanor.
A shop that opened in early 2026 under the old assumptions can be legal on the permit and illegal on the shelf, or the reverse. The two systems are enforced by different machinery (the AG's directory; the permit regime), so "I have my permit" answers nothing about your products, and a clean product list answers nothing about your permit. A Virginia opening plan needs both checks, in either order, before the lease math starts.
Virginia's state page carries the stack with its checked date, and the checker names both Virginia layers when you run VA with a vape mix.
