State license required Origin ban on vapes Hemp (delta-8 / THC-A): banned at smoke shops
How to open a smoke shop in Texas starts with the state stack below — then the product rules, which decide what your shelves may hold — then your city, which decides your address. Run the same facts through the free checker with your exact product mix for a verdict.
| Item | What it is |
|---|---|
| Business registration + sales tax permit | Register the business and get the seller's permit first — the tobacco application asks for it. |
| Tobacco retailer permit + separate E-Cigarette Retail Permit | Issued by: Texas Comptroller of Public Accounts. Fee: E-cigarette permit: $180 for 2 years (industry guides, 2026). |
| E-cigarette / e-liquid requirements | Texas licenses e-cigarette retail separately from tobacco retail (SB 2024 era). A vape-selling shop files for both permits. |
| Local business license | Plus any local tobacco permit your city runs, and fire/occupancy sign-off where required. There is no federal retail license for a smoke shop. |
